LightningChart Student License End-User License Agreement

By installing, copying, or otherwise using LightningChart products, including and not limited to LightningChart .NET, LightningChart JS, and LightningChart Python, you agree to be bound to the terms of this agreement. If you do not agree to these terms, do not use the software.

LightningChart products are licensed, not sold or given.

This End-User License Agreement (“EULA”) is a legal agreement between you, a student (“Licensee”) and LightningChart Ltd (“LightningChart”), applying to all LightningChart products (“Software”), libraries, source code, demo applications, documentation, and other material that can be considered to be part of Software or intellectual property of LightningChart Ltd.

STUDENT LICENSE GRANT

Student license is intended for schoolwork, such as programming tasks, and thesis work. Student license is free of cost, and it comes with limitations and obligations.

ARTICLE I – WATERMARKS

Student license will show a watermark over the chart. Hiding the watermarks is forbidden.

ARTICLE II – COMMERCIAL DISTRIBUTION

Developing or distributing a commercial application is forbidden.

“Commercial” means any use where the application (a) is sold/licensed for a fee, (b) is used to provide paid services, (c) is monetised (ads, sponsorship, paid access), or (d) is developed under an obligation to, or primarily for the benefit of, a commercial entity.

ARTICLE III – TECHNICAL SUPPORT

LightningChart does not provide dedicated technical support for student licenses. Students are, however, encouraged to write questions to LightningChart online communities, including Reddit, Quora, and Stack Overflow.

ARTICLE IV – STATUS VERIFICATION

To grant a license, students must provide official and valid proof that accredits their active student status. Students must provide a valid student email address and upload their study certificate. All information and documentation provided are subject to verification and may be rejected without notice if proven illegitimate.

ARTICLE V – STUDENT PROJECTS

Students must provide information on the project they intend to use LightningChart products for. The projects can and will be used by LightningChart in their official communications. LightningChart may contact the Licensee for further information about the project.

ARTICLE VI – LICENSE VALIDITY

The license validity for LightningChart .NET and LightningChart JS is for one (1) year. LightningChart Python is available free of charge for non-commercial usage; its validity is indefinite, and its EULA must be followed.

ARTICLE VII – ATTRIBUTION

LightningChart must be credited in the student work, thesis, or project with the following legend: “This project was developed with a student license granted free of charge by LightningChart Ltd (www.LightningChart.com).”

ARTICLE VIII – ACTIVATION

In the case of LightningChart .NET, the license requires activation to the LightningChart licensing server. An internet connection is required for activating it instantly online. Offline activations may require a day or two. For other products, the license activation key is sent immediately via email after the documentation has been validated.

LightningChart grants you, as an individual student, a personal and non-exclusive license to install and use the Software for designing, building, testing, and deploying non-commercial applications and programs you create. The license cannot be transferred to another developer without written permission from LightningChart.

ARTICLE IX – USAGE LIMITATIONS

The Licensee may install the Software into one (1) development computer, per one single license, and may use a version of the Software built before the license expiration date. The Licensee may not distribute or share the license key files, license key strings, or setup files of the Software with others. The Licensee cannot distributethe  LightningChart .NET “License Manager” program. The Licensee cannot distribute any LightningChart library in commercial applications.

The Licensee is strictly forbidden from creating rival software products based on any of the libraries or their source code.

The Licensee cannot assume ownership of LightningChart when creating derivative software works.

The Licensee is forbidden from reverse-engineering, decompiling, or disassembling any of the libraries.

The Licensee cannot rent or lease the Software to anyone.

The license cannot be transferred to another developer without written permission from LightningChart.

In the case of LightningChart .NET, the Licensee cannot use any online map tile data service’s license keys, which may be possibly provided within example code, in their own Licensee’s applications.

ARTICLE X – GEOMAPS DATA SERVICES

By this license agreement, LightningChart does not provide or grant any license for any online map tile data service. Using online tile maps requires obtaining an online map data license from the tile data provider and applying the service’s license keys in your application.

ARTICLE XI – WARRANTY AND DISCLAIMER

LightningChart will not provide any warranty and cannot take any obligation to fix bugs or otherwise improve the software based on student licensee requests.

LightningChart does not guarantee that any functions contained in the components will meet your requirements, or that its operations will be error-free. The entire risk as to the library performance or quality, or both, is solely on the users and not LightningChart. A trial version of the product is always available for you to evaluate the suitability for your software application. You take responsibility when selecting the software component for your application to achieve your intended results.

Geographic maps delivered with the Software, or imported by the developer, are as accurate as the source data is. LightningChart does not guarantee the accuracy of the map source data provided by several suppliers. LightningChart will not be liable for any time loss or accident caused by inaccurate maps or their presentation.

LightningChart does not guarantee the operation of online map tile data services, such as MapQuest, Here, or WeatherBug. If internet connectivity problems exist, such service is offline, the retrieve rate limit has been exceeded, the service’s licensing policy has changed, data transfer protocols or data transfer commands have been changed, or the service has been permanently shut down.

To the maximum extent permitted by applicable law, in no event shall LightningChart be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other loss) arising out of the use of or inability to use the Software even if LightningChart has been advised of the possibility of such damages.

ARTICLE XII – GOVERNING LAW

This EULA will be governed by the laws of Finland without reference to its choice of law rules. Any dispute, controversy, or claim arising out of or relating to this EULA or the breach, termination, or validity thereof shall be finally settled at LightningChart’s discretion (i) at your domicile’s competent courts; or

(ii) by arbitration in accordance with the Rules for Expedited Arbitration of the Finland Chamber of Commerce. The arbitration shall be conducted in Helsinki, Finland, in English language.

ARTICLE XIII – PERFORMANCE COMPARISONS AND BENCHMARKS

Using LightningChart products for performance comparison tests or publishing such test results without permission given by LightningChart beforehand in writing is strictly forbidden. LightningChart does not permit LightningChart or LightningChart trade names, registered trademarks, company names, brand names or alike to be used as references of any kind without permission given by LightningChart beforehand in writing, except for the attribution required under Article VII. Direct and indirect damages inflicted by violating these terms will be claimed from the violating party to the maximum extent by applicable law.

ARTICLE XIV – REFERENCE CUSTOMER

LightningChart may use Licensee as a reference customer, unless requested not to do so by Licensee.

ARTICLE XV – VIOLATION WITH LICENSING TERMS – TERMINATION OF LICENSE

If Licensee has violated the License Agreement terms, LightningChart Ltd has the right to terminate the license and all services regarding Software. In such a case, LightningChart may blacklist the license keys and refuse all related services.
